Stadium Regulations

Section 1 - Area of validity

1. The area covered by these Stadium Regulations consists of the VELTINS Arena complex, the public transport facility on Kurt-Schumacher-Strasse, the Park Stadium, including the paths and green spaces to the south of the A 2 autobahn, and the car parks to the north of Willy-Brandt-Allee and west of Adenauerallee.

The cinema complex, Sport-Paradies leisure centre, Berger Feld Comprehensive School, the rehab clinic, the hotel and the disaster prevention centre are not covered by these Stadium Regulations.

The area of validity is indicated by an unbroken line on the attached site plan, which forms a constituent part of these Stadium Regulations.

The section of the VELTINS Arena that is enclosed by a fence is shown by a broken line on the site plan.

2. The Stadium Regulations apply to all events taking place at the VELTINS Arena or on the auxiliary sites (car parks, public transport facility) on the respective days of the event.

Section 2 - Authorised persons

Only persons in possession of a valid admission ticket or pass or persons otherwise able to demonstrate their entitlement to attend an event are entitled to enter the fenced-in area of the VELTINS Arena on the day of the event. Admission tickets and passes must be shown and surrendered for inspection to stewards, local authority enforcement officers or the police on demand.

Section 3 - Entry checks

1. All patrons entering the fenced-in area of the VELTINS Arena are obliged on demand to show their admission tickets or passes to stewards, local authority enforcement officers or the police and to surrender said tickets or passes for inspection.

2.  Persons unable to demonstrate an entitlement to enter the stadium or subject to a local or nationwide banning order for sporting events will not be permitted to enter the stadium complex. They will be turned away by the stewards, local authority enforcement officers or the police or ejected from the fenced-in area of the VELTINS Arena if encountered there.

3. Persons clearly under the influence of alcohol or drugs or in possession of a weapon or dangerous object as defined in Section 5 and unwilling to surrender said weapon or object to the stewards are not allowed in the stadium.

Persons with a blood alcohol content of more than 0.16% will generally be refused entry to the VELTINS Arena.

4. Should a person be suspected, on account of their conduct or other details or observations, of being subject to a local or nationwide stadium ban for sporting events, of being under the influence of alcohol or drugs, or of being in possession of a weapon or dangerous object as defined in Section 5, the stewards are entitled, with said person's consent, to conduct a search of clothing and containers for the purpose of clarifying the situation, to ascertain whether they are under the influence of alcohol or drugs, which process may involve the use of equipment, and, if there is a possibility of their being subject to a stadium ban, to verify the person's identity by inspecting their identity papers.

5. Persons refusing to grant consent in accordance with Para. 4 will be denied entry to the fenced-in area of the VELTINS Arena or will be ejected from the fenced-in area of the VELTINS Arena if encountered there.

6. FC Schalke 04 opposes xenophobic, racist, violence-glorifying, anti-Semitic and extreme left- or right-wing or ethnic tendencies.

Persons whose outward appearance, in particular, alludes to an extreme position with respect to their political views may therefore be excluded from an event.

Outward appearance includes, in particular, a typical style of dress, which may involve themed graphic elements in which various combinations of numbers and/or letters clearly indicate the views of the wearer.

Further, anyone expressing such extreme views through flags, propaganda material or utterances may be excluded from an event.

Section 4 - Conduct in the area of validity of the Stadium Regulations

1. Within the area of validity of these Stadium Regulations all persons must conduct themselves in a manner that does not cause damage to items of value or endanger, harm or, by more than is inevitable in the circumstances, hinder or disturb any other person.

2. Instructions issued by stewards, local authority enforcement officers, the police, the fire brigade, medics and the stadium announcer are to be followed at all times.

3. Patrons are obliged to take up their allocated place and to do so using the earmarked entrances. For safety reasons and the avoidance of danger, patrons are also obliged to move to a different seat/standing place, which may be situated in a different section of the stadium to the one indicated on their admission ticket, if instructed to do so by a steward, local authority enforcement officer or the police.

4. Aisles, stairways and escape routes must be kept clear at all times.

5. Standing is not permitted in seating areas while the event is in progress.

6. For safety reasons and the avoidance of danger, the VELTINS Arena itself and the fenced-in area around it are monitored by CCTV.

Section 5 - Prohibitions

1. Persons inside the area covered by the Stadium Regulations may not carry the following items:

a. Weapons or any other dangerous object capable of causing or resulting in injury;

b. Protective gear or clothing or items capable of serving as protective gear and intended according to the circumstances to resist enforcement measures taken by persons vested with the power of authority;

c. spray cans, caustic substances, dyestuffs, flammable liquids or pressurised containers for flammable or harmful gases, with the exception of standard pocket cigarette lighters;

d. bottles (including PET bottles), beakers, mugs, jugs, cans or any other container made of fragile, splintering or very hard material;

non-alcoholic drinks in cartons with a maximum capacity of 0.5 litre may be brought in; 

e. bulky objects such as ladders, stools, chairs, crates, suitcases;

f. fireworks, rockets, hand-held flares, smoke powder, smoke bombs, signal rockets and other pyrotechnics;

g. flags or flagpoles longer than two metres or more than three centimetres in diameter and large banners, twin-pole banners and large quantities of paper or wallpaper rolls;

h. mechanical or electrical noise-making devices; 

i. sound or voice-amplifying devices; 

j. laser pointers;

k. alcoholic beverages of any kind;

l. drugs;

m. animals;

n. violence-glorifying, racist, xenophobic, anti-Semitic or extreme right or left-wing propaganda material;

o. any other items of a nature suitable and intended to cause injury or damage;
p. items suitable and, according to the circumstances, intended to prevent the verification of a person's identity; 

q. cameras, camcorders or any other sound or image-recording devices for commercial use (where no approval has been obtained from the event organiser);

2. Patrons are also prohibited from
a. climbing up, on or over structures or installations not intended for general use, in particular facades, fences, walls, parapets, perimeter fencing, barriers, lighting installations, camera platforms, masts of any kind, roofs, including any guy wires and anchors, trees, hedges or road landscaping of any kind;

b. entering areas marked off-limits or occupying locations or places not intended for patrons;

c. setting up, attaching or storing any objects;

d. spending the night on site;

e. climbing on seats/benches;

f. unfurling banners obstructing the line of sight for the purpose of concealing misconduct;

g. throwing objects;

h. lighting fires or igniting fireworks, rockets, hand-held flares, smoke powder, signal rockets or other pyrotechnics;

i. offering for sale or selling goods without the requisite permits and consent of the stadium operator, distributing printed material, staging collections and selling tickets;

j. defacing, stickering, fly postering, scratching, etching or otherwise damaging physical structures, installations, trees or ways;

k. urinating or defecating outside of the toilets or contaminating the stadium site by any other means, in particular by discarding or leaving behind items;

l. expressing or disseminating violence-glorifying, racist, xenophobic, anti-Semitic or extreme right- or left-wing opinions and discriminating against sections of society through utterances, gestures or other forms of conduct;

m. appearing in a getup suitable and, according to the circumstances, aimed at preventing the verification of the wearer's identity;

n. carrying weapons or objects of a nature suitable and intended to cause injury or damage;

3. Items prohibited from the area covered by the Stadium Regulations may not be offered for sale, sold or made available to others by any other means in said area.

4. It is forbidden to obstruct traffic areas, in particular paths and roads, and set up sales stands on green areas.

5. It is also forbidden to gang up with others in the environs and during events within the meaning of these Stadium Regulations. Ganging up is when several people come together with the evident aim of disturbing the peace.

Section 6 - Violations

1. Any person wilfully or negligently committing a breach of Section 5 of these Stadium Regulations may be ejected from the VELTINS Arena and its environs without compensation or refund of the admission price. This also applies to persons clearly under the influence of alcohol or drugs.

2. Any person whose behaviour inside or outside the stadium complex in connection with an event constitutes a breach of the Stadium Regulations may be issued with a stadium ban. This entry ban may, with due regard for the principle of proportionality, be restricted to the area covered by the VELTINS Arena or may have nationwide effect.

3. If the event organiser is served with a claim for damages and/or issued a fine by a third party (German FA, UEFA, FIFA, etc.) due to a patron's improper conduct, legal recourse will be taken against the perpetrator.

4. Charges will be brought against any patron thought to have committed a criminal act. Charges may be brought for misdemeanours.

5. Prohibited items will be confiscated and taken into safekeeping and, provided they are not required as evidence in preliminary misdemeanour or criminal proceedings, returned to the person from whom they were confiscated upon cessation of the conditions necessitating their confiscation.

Exempt from return are the items set forth in Section 5, Para. 1 a, b, f, l and n.

6. Wilfully or negligently failing to comply with the instructions of stewards, local government enforcement officers, the police, the fire brigade, medics or the stadium announcer in breach of Section 4, Para 2 or blocking aisles, stairways or escape routes in breach of Section 4, Para. 4 shall constitute an offence.

Section 7 - Scope of event organiser's liability 

1. These Stadium Regulations do not limit the liability of the event organiser, his legal representatives and his vicarious agents under product liability law or for loss or damage arising from injury to life, limb or health.

2. The event organiser's liability for any other loss or damage not referred to at Para. 1 is excluded, unless the loss or damage is attributable to:

a. a wilful or grossly negligent breach of duty by the event organiser, his statutory representatives or vicarious agents or

b. the breach of a duty of major significance for the accomplishment of the purpose of the contract. Upon a breach of a significant duty within the meaning of the aforementioned sentence 1 b), the event organiser's liability shall be limited to foreseeable and typical loss or damage only.

3. The exemption of liability pursuant to Paras 1 and 2 shall also apply to the liability of the event organiser's vicarious agents and statutory representatives.

4. Accidents or damage must be reported to the event organiser without delay.

Section 8 - Film and sound recordings

1. All patrons of an event at the VELTINS Arena consent to the event organiser, and third parties authorised by the event organiser, making, copying, broadcasting and using image and sound recordings of patrons in any audiovisual media without payment of compensation.

2. The event organiser's rights arising out of Para. 1 shall apply indefinitely worldwide.

Section 9 - Exceptions

By agreement with the event organiser and the police, individual patrons of the VELTINS Arena may be granted permission to carry flags larger than those referred to at Section 5, Para. 1 g. The event organiser also reserves the right, in consultation with the police, to agree individual arrangements with regard to large banners and/or megaphones/drums.

This is subject to the proviso that the patrons concerned submit a timely request to the event organiser.

Section 10 - Linguistic equivalence

With regard to descriptions of persons and functions the masculine includes the feminine.

Section 11 - Final provision

The Stadium Regulations enter into force on 1 October 2008.
